Abstract
This chapter examines the duty of secrecy that a bank owes to its customers under Hong Kong law. In Hong Kong, a bank may be required to keep customer information confidential under an express agreement by virtue of an implied contract between the banker and customer as a result of fiduciary obligations, or under the general equitable law of confidence. The focus of this chapter is the duty that arises as a result of an express or implied contract based upon the commercial relationship between the banker and the customer.
