Abstract: 在都市化進程加速的中國鄉村社會中,秩序從被打破到重建的過程,就是國家權力與村社權力摩擦與融合的過程. 廟會宴會習慣是具有社群連帶性 聲譽(資訊)與懲罰的強制執行機制,是村社內部無須法律的秩序. 但這項習慣帶來鋪張浪費 打架鬥毆與交通事故等治安問題,卻屬於政府的治理範圍. 於是,當村民因習慣壓力無法克服外部性;村社組織規則自治存在限度;外部法律供給不足時,政府透過選擇性的介入 策略性的干預與嵌入式的治理,實現行政禁令的轉化 內化,與習慣整合,形成村社自治與政府治理的合作,鄉村秩序得以再生.
